This notice (hereinafter “the Notice”) informs the user about how PLANNING FAMILIAL asbl (hereinafter “PLANNING FAMILIAL” or “we”) collects, uses, shares and processes your personal data in the context of your relationship with PLANNING FAMILIAL as a beneficiary (adult or minor), partner, supplier or user of PLANNING FAMILIAL websites (www.planning-familial.lu, www.macontrecaption.lu, www.cesas.lu) or any person interested in our services and in accordance with the applicable laws and regulations on the protection of personal data, in particular the General Data Protection Regulation 2016/679 (GDPR) in force since May 25, 2018.
The Notice sets out the purposes for which we collect and process your data, the categories of data processed, the categories of recipients, the safeguards in place, and the length of time we keep your data.
For the purposes of this Notice, personal data means any information relating to an identified or identifiable individual and includes any data that is or can be attributed to a natural person in any way whatsoever. PLANNING FAMILIAL controls the way in which personal data is collected as well as the purposes for which it is used by acting as data controller within the meaning of the RGPD.
1/ Categories of personal data collected
PLANNING FAMILIAL processes personal data if and to the extent permitted by law or if there is an appropriate legal basis.
Data we collect automatically:

In addition, when you access our websites, we automatically collect the following information: IP address, browser type and version, operating system used, device ID, time of visit and requests made.
Data you provide voluntarily:
PLANNING FAMILIAL collects your data when you contact PLANNING FAMILIAL directly via any communication channel (e.g. email). In this case, PLANNING FAMILIAL collects your data such as name, e-mail address, telephone number, reason for contact and the content of messages sent.
Finally, as part of your contractual relationship with PLANNING FAMILIAL, we may collect additional information about you, provided that it is strictly necessary for the management of your file. This information includes the following categories of personal data:

2/ Processing purposes and legal basis
PLANNING FAMILIAL only processes personal data for a specific purpose and only processes personal data that is relevant to achieving that purpose.
Data is processed for the following purposes:
- Legal basis: The processing is necessary for the performance of a contract or pre-contractual measures taken on your initiative.
- Purpose:
-Manage your file and provide you with the services you require, such as: Medical and psychological care and procedures; Social assistance; Individual interviews related to sex education.
Co-organize and monitor training courses in partnership with training organizations (manage registration lists, issue final certificates, etc.). - Legal basis: The processing is necessary to comply with our legal obligations.
- Purpose: To comply with the obligations imposed by legislative texts such as, for example, the law of July 24, 2014 on patients’ rights and obligations.
- Legal basis: The processing is necessary for the pursuit of our legitimate interests.
- Purpose: to provide the information you have requested (e.g. to respond to a contact request), outside any contractual relationship; to ensure the security of our information systems and websites;
to protect our rights and interests in the event of litigation. - Legal basis: The processing is based on your explicit consent.
- Purpose: to manage your subscription to our newsletter available on the www.cesas.lu site; to produce and analyze statistics on visits to our www.cesas.lu, www.planning-familial.lu and www.macontraception.lu sites.
PLANNING FAMILIAL will only use personal data for the purpose for which it was collected, unless PLANNING FAMILIAL reasonably believes that the data should be used for another reason and that this reason is compatible with the original purpose. If PLANNING FAMILIAL needs to use personal data for unrelated purposes, you will be informed, including the legal basis that allows PLANNING FAMILIAL to do so.
3/ Data recipients
PLANNING FAMILIAL may use or disclose personal data if PLANNING FAMILIAL is legally required to do so or if PLANNING FAMILIAL believes that this is necessary to protect its rights and/or to comply with applicable law or regulation.
PLANNING FAMILIAL may therefore share personal data with certain third parties in accordance with its legal or contractual obligations. These include M3S, STM, ADEM, the Ministry of Labor, the Public Prosecutor’s Office (on justified request), external care structures, private doctors or even service providers acting as subcontractors within the meaning of the RGPD. In such a case, a contract in accordance with Article 28 shall be drawn up between the subcontractor in question and PLANNING FAMILIAL.
None of these third parties or subcontractors is based or processes personal data outside the European Union (EU). If a third party processes personal data outside the EU/EEA as part of PLANNING FAMILIAL’s activities, the transfer will only take place if an appropriate level of data protection has been confirmed for the third country by the European Commission or if other appropriate data protection guarantees exist (binding corporate data protection rules (BCR) or standard contractual clauses).
4/ Data security
PLANNING FAMILIAL undertakes to implement technical and organizational measures to ensure the security of data and to protect them against disclosure to unauthorized persons. PLANNING FAMILIAL ensures that staff authorized to process personal data have received appropriate training in the protection of personal data and are subject to an obligation of confidentiality.
5/ Data retention period
Data is stored on servers located in Luxembourg.
No personal data is retained beyond what is necessary for the purposes for which it is to be used. The data retention period is defined with regard to our legal and contractual constraints and, failing that, according to our needs. Once these deadlines have passed, the data is either deleted or anonymized.
Data stored in log files is kept for 14 months from the date of collection.
Your personal data will be kept for 10 years from the end of your treatment.
Where processing is based on consent, you may withdraw your consent at any time. Such withdrawal will not affect the lawfulness of the processing carried out prior to such withdrawal. You can unsubscribe from our newsletter by clicking on the unsubscribe link at the bottom of each email we send you.
We may also collect anonymous statistical data for the purpose of producing annual reports, in accordance with our contractual obligations under an agreement with the French Ministry of Health.
6/ Rights of data subjects
As an individual, you have a number of rights which you may exercise in certain circumstances:
- Right of access: obtain access to and a copy of data;
- Right of rectification: request at any time that inaccurate or incomplete data be rectified or completed;
- Right to erasure: requesting the deletion of data when, for example, the data is no longer necessary for the purposes for which it was collected or processed;
- Right to restrict processing: request restriction of processing if, for example, the accuracy of the data is disputed, or in the event of opposition to processing;
- Right to portability: to have data transferred to another data controller in a structured, commonly used and machine-readable format, if the processing is carried out by automated means or is based on prior consent ;
- Right to object to processing: object to data processing and withdraw consent if processing is based on consent (particularly if data is used for commercial prospecting purposes).

All requests will be processed within 1 month of confirmation of the applicant’s identity. This deadline may be extended by a further 2 months in the case of a complex application or a large number of applications.
